Terms of Use
This DRB Toolkit and its accompanying materials are governed by these Terms of Use. The term “Toolkit” includes all accompanying documentation and materials. Your use or copying of this Toolkit is your agreement to these Terms of Use.
This Toolkit is licensed, not sold. These Terms of Use only give you some limited rights to use the Toolkit. The DRB Toolkit Workgroup and its members reserve all other rights. Unless applicable law gives you more rights despite this limitation, you may use the Toolkit only as expressly permitted in these Terms of Use. You may use the Toolkit solely for your internal business purposes. You may install and use a single copy of the Toolkit on a single computing device owned or controlled by you. You may not:
i. copy the Toolkit, except for backup or archival purposes;
ii. publish or post any portion of the Toolkit for third parties to copy;
iii. distribute any portion of the Toolkit;
iv. sell, rent, lease, lend, host or sublicense any portion of the Toolkit; or
v. otherwise transfer the Toolkit to any third party.
Notwithstanding the foregoing, you may not host the Toolkit on a server for access by multiple workstations, as each copy of the Toolkit was designed for a single workstation use, provided that your use is limited to internal single-site use and provided that multiple users can access that shared workstation, there is no separate license required for each user only per workstation.
All intellectual property markings and credits (including the above copyright notice and these Terms of Use) must be retained in all copies.
You may integrate the Toolkit with your internal disaster programs, so long as the manner of such integration (i) does not create confusion as to DRB Toolkit Workgroup’s copyright ownership in the Toolkit, and (ii) does not create confusion between Toolkit and non-Toolkit materials. Copies must be marked (or, for a hosted copy on a website you control, are introduced with) the following statement: "Portions reproduced by [INSERT YOUR NAME] with permission from the DRB Toolkit Workgroup." You must have purchased a separate license for each of your internal disaster preparedness plans or programs that integrate the Toolkit. Except as set forth in this paragraph, you may not modify the Toolkit.
This Toolkit and the results or output are PROVIDED “AS IS,” “WITH ALL FAULTS” AND WITH NO EXPRESS OR IMPLIED WARRANTIES INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT and may include technical inaccuracies or typographical errors. YOU BEAR ALL RISK OF USING THE TOOLKIT. Any proper names or data used or events portrayed may be fictitious and for illustrative purposes only. In licensing to you the Toolkit, DRB Toolkit Workgroup is not rendering disaster preparedness professional or other services for or on behalf of you or any third party. This Toolkit is not designed nor intended for use in testing, certifying or inspecting any disaster preparedness products, processes or programs. The DRB Toolkit Workgroup disclaims responsibility for and does not endorse any referenced third party resources including web links. Third party resources may have additional use and privacy terms.
The DRB Toolkit Workgroup shall not, at any time, be liable for any special, direct, indirect or consequential damages, whether in an action of contract, negligence or other action arising out of or in connection with the use or performance of the Toolkit. This limitation applies even if the DRB Toolkit Workgroup knew or should have known about the possibility of the damages.
Because this Toolkit is “as is,” we are not obligated to provide support services for it.
If you give feedback about the Toolkit to the DRB Toolkit Workgroup, you give to the DRB Toolkit Workgroup, without charge, the right to use, share and commercialize your feedback in any way and for any purpose. These rights survive this agreement.
These Terms of Use are the entire agreement for the Toolkit and replace all other agreements and understandings between us regarding the Toolkit. Washington state law governs the interpretation of these Terms of Use and applies to claims for breach of them, regardless of conflict of laws principles.
Your right to continued use of the DRB Toolkit is conditioned upon your compliance with these Terms of Use. The DRB Toolkit Workgroup reserves the right to update these Terms of Use at any time upon notice to you.
Privacy Policy
The Disaster Resistant Business Toolkit Workgroup (“Company,” “we,” “us,” or “our”) is committed to protecting your privacy.
We may occasionally collect and use information (“Data”) gathered during the use of the DRB Toolkit website (the “Service”), including “cookies” used to help customize your access to the DRB Toolkit. Such Data may contain personally identifiable information (“PII”). PII is information that you provide to us that personally identifies you, such as your name, email address, or billing information, or other data that can be reasonably linked to such information by Company.
Company may use Data, including PII, for Company’s internal use, to make shopping through the Service possible, and to enhance your overall future experience with the Service. However, Company will not sell, trade, or rent your PII to others, and will not disclose PII in a form that personally identifies you unless we have your prior consent, unless Company has a good-faith belief that such action is necessary to: (i) comply with legal process or other legal requirements of any governmental authority; (ii) protect and defend the rights or property of Company; (iii) enforce this Privacy Policy or Company’s End User License Agreement; (iv) protect the interests of users of the Service other than you; or (v) operate or conduct maintenance and repair of Company’s service or equipment.
